These Terms & Conditions of Sale ("Terms") govern purchases of products and services from Papercrane Design, LLC dba Trophyology ("Trophyology," "we," "us," or "our") and use of this website in connection with those purchases.
By placing an order, approving a quote or proposal that incorporates these Terms, or completing a purchase through our website, you agree to these Terms.
If a Trophyology quote, proposal, order confirmation, or other written agreement contains terms that conflict with these Terms, the terms of that document will control with respect to that order.
If you are placing an order on behalf of a company, organization, or other entity, you represent that you have the authority to bind that entity to these Terms, and "customer" and "you" refer to both you and the entity on whose behalf you are acting. Trophyology may rely on that representation and may pursue either or both parties for amounts owed under an order.
Product Quality
Our awards, trophies, plaques, and gifts are handcrafted from premium materials, including wood, metal, glass, and other natural or manufactured materials. Each piece is carefully designed and crafted with attention to detail.
Because of the handcrafted nature of our work, no two pieces are exactly alike. Each piece may have variations that contribute to its individual character.
For products made from natural wood, variations in color, grain, texture, figure, and density are expected and are not considered defects. Similar variations may occur in other handcrafted or natural materials and finishes.
All dimensions listed on our website, catalog, quotes, or other materials are approximate unless expressly stated otherwise. Slight variations may occur as a result of materials and handcrafted production.
Product photographs, renderings, digital proofs, and screen displays are intended to represent our products as accurately as reasonably possible, but colors, materials, finishes, proportions, and other physical characteristics may appear differently in person.
Pricing + Quotes
Each award, plaque, and gift is priced based on factors including design, complexity, materials, finish, personalization, and quantity. Pricing may be available on our website, in our pricing catalog, or by quote.
Quotes are valid for 30 days from the date issued unless otherwise stated. Pricing on quotes older than 30 days is subject to change based on current material, labor, production, and other costs.
Applicable sales tax, shipping, delivery, duties, customs fees, and other charges may be added where appropriate.
Ordering + Payment
Order Confirmation
A deposit in the amount specified in your quote, proposal, or invoice is required to initiate an order unless otherwise agreed in writing.
An order is considered confirmed when the required deposit has been received and any information reasonably required to begin the project has been provided.
Production scheduling may also depend on final artwork approval, material availability, and other project-specific requirements.
Final Payment
Unless otherwise agreed in writing:
- The remaining balance is due upon completion and before shipment.
- Payment may be processed automatically using an authorized payment method or an invoice may be sent electronically.
- We accept payment methods made available by Trophyology, which may include ACH, company check, and credit card.
If you prefer an alternative available payment method or a courtesy notification before an authorized final payment is processed, please let us know in advance.
Customers with approved payment terms are responsible for payment in accordance with the terms stated on the applicable invoice.
Deposits
Deposits are non-refundable once an order is confirmed because Trophyology may commit design time, production capacity, materials, and other resources to the order.
Artwork + Personalization Approval
Customers are responsible for carefully reviewing all proofs before approval, including names, titles, dates, spelling, punctuation, logos, artwork, quantities, materials, finishes, award categories, and other personalization details.
Approval of a proof constitutes authorization for Trophyology to produce the order as shown.
Trophyology is not responsible for errors contained in customer-approved artwork or proofs, including errors originating in information supplied by the customer. Costs associated with correcting or reproducing customer-approved work may be the customer's responsibility.
If Trophyology produces an item differently from the approved proof or order specifications due to an error by Trophyology, we will work promptly to correct the issue.
Changes requested after artwork approval may result in additional design, setup, material, or production charges and may affect the production schedule.
Digital proofs and renderings are intended to communicate design and personalization and are not exact representations of physical materials, colors, grain, finishes, engraving, or other characteristics of the completed piece.
Customer-Provided Content + Intellectual Property
Customers may provide Trophyology with names, text, logos, trademarks, photographs, artwork, or other materials for use in connection with an order.
By providing these materials, the customer represents that it has the rights and permissions necessary for Trophyology to use them in connection with the project and grants Trophyology permission to reproduce, modify as reasonably necessary for production, and otherwise use the materials to design, produce, fulfill, and deliver the order.
Customers retain ownership of their trademarks, logos, and other intellectual property provided to Trophyology.
Unless expressly agreed otherwise in writing, Trophyology retains all rights, title, and interest in its original product and award designs, concepts, sketches, artwork, electronic design and production files, schematics, models, prototypes, construction details, processes, and other original creative work.
Payment for a custom or modified product does not transfer ownership of Trophyology's underlying design or intellectual property unless Trophyology expressly agrees to such a transfer in writing.
Trophyology designs may not be copied, reproduced, reverse engineered, fabricated, or provided to another manufacturer for fabrication without prior written permission from Papercrane Design, LLC dba Trophyology.
Products expressly identified as Partner Products may be subject to different intellectual property rights or restrictions.
Production + Lead Times
Production and shipping timelines are estimates unless Trophyology expressly agrees in writing to a guaranteed date.
Production timelines generally begin after Trophyology has received the required deposit, final artwork approval, and all information necessary to produce the order.
Customer-requested changes, delayed approvals, changes in quantity, material availability, supplier disruptions, production circumstances, carrier delays, and other factors may affect estimated completion or delivery dates.
If you are ordering for a specific event or in-hand date, please provide that date when requesting your quote or placing your order so we can confirm the appropriate production timeline.
Rush production may be available for some orders and may incur additional charges.
Shipping + Delivery
Shipping Methods
We typically ship using carriers such as UPS, FedEx, or USPS. DHL or other services may be available for international shipments.
Shipping charges are the customer's responsibility unless otherwise stated in writing.
Insurance + Risk of Loss
Shipments arranged by Trophyology are generally insured against covered loss or damage in transit.
Risk of loss passes to the customer when the order is delivered to the shipping carrier, except as otherwise required by applicable law. Trophyology will reasonably assist customers in pursuing claims for covered loss or damage involving shipments arranged and insured by Trophyology.
Where a customer provides its own shipping account or arranges transportation, shipping charges, insurance, risk, customs, duties, taxes, and other carrier-related obligations may be the customer's responsibility.
International customers are responsible for applicable customs duties, import taxes, brokerage charges, and other import-related costs unless otherwise agreed in writing.
Inspection + Freight Damage
Please inspect your order promptly upon delivery.
If your shipment arrives with visible or suspected freight damage:
- Notify Trophyology as soon as possible and preferably within 3 business days of delivery.
- Provide photographs of the shipping carton, packaging, shipping label, and affected products.
- Retain all original packaging and damaged materials until we advise that they may be discarded.
Trophyology will assist with applicable freight claims and provide further instructions for resolution.
Returns, Defects + Errors
Because most Trophyology products are custom-made or personalized, custom orders are final and are not eligible for return, exchange, or refund due to customer preference, customer-provided errors, or a change of mind.
This policy does not limit remedies available for a verified defect or error caused by Trophyology or any right or remedy that cannot lawfully be excluded.
Defects + Trophyology Errors
If there is an unnatural defect, production error, or other issue not related to the inherent variations described under Product Quality, please notify us promptly and preferably within 3 business days of receiving your order.
We will review the concern and work promptly toward an appropriate resolution.
Customer-Provided or Approved Errors
If an error results from incorrect information supplied by the customer or information contained in a customer-approved proof, costs associated with correcting, reproducing, or reshipping the affected products may be the customer's responsibility.
Changes + Cancellations
Because Trophyology's work is custom and production resources may be committed specifically to an order, changes, reductions, and cancellations become increasingly difficult once an order is underway.
Orders may not be canceled or reduced after final artwork approval, after materials have been specifically committed to the order, or after production has begun, whichever occurs first, unless Trophyology agrees otherwise in writing.
Deposits are non-refundable once an order is confirmed.
Changes requested after an order is confirmed or artwork is approved may result in additional charges and changes to the production or delivery schedule.
Completed Orders + Customer Delays
Customers are responsible for providing timely approvals, information, payment, shipping instructions, and other items reasonably required to complete and deliver an order.
Trophyology is not responsible for delays resulting from the customer's failure to provide required information, approvals, or payment.
If a completed order cannot be shipped or delivered because of a customer delay, Trophyology may charge reasonable storage, handling, or related costs after providing notice to the customer.
Disclaimer of Warranties
Except as expressly stated in these Terms, and to the fullest extent permitted by applicable law, Trophyology disclaims warranties of any kind, express or implied, including implied warranties of merchantability and fitness for a particular purpose.
Trophyology does not warrant that handcrafted products will be free from the natural variations in materials, appearance, dimensions, or finish described in these Terms.
Nothing in these Terms excludes, disclaims, or limits any warranty, right, or remedy that cannot lawfully be excluded, disclaimed, or limited.
Limitation of Liability
To the fullest extent permitted by applicable law, Papercrane Design, LLC dba Trophyology's aggregate liability arising out of or relating to an order will not exceed the amount paid by the customer for the order giving rise to the claim.
To the fullest extent permitted by applicable law, Trophyology will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, loss of business opportunity, or business interruption, arising out of or relating to an order or the purchase or use of our products or services.
Nothing in these Terms excludes or limits liability, rights, or remedies to the extent such exclusion or limitation is prohibited by applicable law.
Force Majeure
Trophyology will not be liable for delay or failure to perform resulting from circumstances outside our reasonable control, including material shortages, supplier disruptions, carrier delays, severe weather, natural disasters, fire, utility or internet interruptions, labor disputes, governmental actions, public emergencies, or other events beyond our reasonable control.
Any affected production or delivery timeline may be extended for a reasonable period based on the circumstances.
Governing Law + Disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles.
Subject to any rights or remedies that cannot lawfully be waived, any dispute arising out of or relating to these Terms or an order shall be brought in the state or federal courts having jurisdiction in Travis County, Texas, and the parties consent to the jurisdiction and venue of those courts.
Privacy
Our collection, use, and disclosure of personal information in connection with our website, products, and services are described in our Privacy Policy.
General
Entire Agreement. These Terms, together with the applicable quote, proposal, order confirmation, or invoice, constitute the entire agreement between you and Trophyology with respect to an order and supersede any prior or contemporaneous understandings, whether written or oral, regarding that order.
Severability. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Waiver. Trophyology's failure to enforce any provision of these Terms is not a waiver of our right to enforce that or any other provision at a later time.
Assignment. You may not assign or transfer these Terms or any order without Trophyology's prior written consent. Trophyology may assign or transfer these Terms or an order, including in connection with a merger, acquisition, financing, or sale of assets.
Changes to These Terms
We may update these Terms from time to time to reflect changes in our products, services, practices, or legal requirements. The "Last updated" date at the top of this page reflects the most recent revision.
The Terms applicable to an order are those in effect when the order is placed or otherwise accepted, unless Trophyology and the customer agree in writing to different terms.
Changes to these Terms will not retroactively modify the terms applicable to an existing order.
